This Policy applies to users of our Services, individuals whose information appears in content uploaded to our Services (such as participants in recorded sales calls), and visitors to our Website.

Please read this Policy carefully. By using our Services, you acknowledge that you have read and understood this Policy. If you do not agree with our practices, please do not use our Services.

1. Information We Collect

1.1 Information You Provide

Account Information: When you create an account, we collect your name, email address, company name, and password.

Payment Information: If you purchase a subscription, we collect billing information through our secure payment processors. We do not store complete credit card numbers on our servers.

Contact Information: Information you provide when contacting us for support, sales inquiries, or other communications.

Integration Credentials: If you connect third-party services (such as CRMs, calendar systems, or payment processors), we collect the credentials and access tokens necessary to maintain those integrations.

Calendar Data: If you connect your calendar to enable our AI Notetaker, we access your calendar events to identify scheduled calls and automatically join them. We collect meeting titles, times, participants, and meeting links.

1.2 Customer Content

Our Services are designed to analyze sales call recordings and related data. When you or your organization use our Services, we process:

Audio and Video Recordings: Sales call recordings uploaded to the platform or captured by our AI Notetaker when it joins your live calls.

Live Call Data: When you use our AI Notetaker feature, the notetaker bot joins your scheduled video conferences (such as Zoom, Google Meet, or Microsoft Teams) to record and transcribe the call in real-time.

Transcripts: Text transcriptions generated from audio and video recordings, whether uploaded or captured live.

Call Metadata: Information about calls such as date, time, duration, participants, and outcomes.

Derived Insights: Analytics, patterns, buyer profiles, and other insights generated by our AI from your content.

Important: Customer Content may contain personal information about third parties (such as prospects or customers on recorded calls). Our customers are responsible for ensuring they have obtained all necessary consents before uploading such content to our Services or enabling our AI Notetaker to record calls. See Section 7 (Customer Responsibilities) for more details.

1.3 Information Collected Automatically

Device Information: Information about the device you use to access our Services, including device type, operating system, browser type, and unique device identifiers.

Usage Information: Information about how you interact with our Services, including features used, pages visited, actions taken, and time spent.

Log Data: Server logs that record information such as IP address, access times, and referring URLs.

Cookies and Similar Technologies: We use cookies, pixels, and similar technologies to collect information about your browsing activities. See Section 10 (Cookies) for more details.

2. How We Use Your Information

We use the information we collect for the following purposes:

2.1 To Provide and Operate Our Services

Process and analyze Customer Content to generate insights, creative briefs, and other outputs; manage your account; provide technical support; and communicate with you about your use of the Services.

2.2 To Improve Our Services

Analyze usage patterns to understand how our Services are used; identify and fix bugs and errors; develop new features and functionality; and enhance the performance, security, and reliability of our Services.

2.3 For AI Model Training (With Consent Only)

If you provide explicit consent, we may use Customer Content to train, develop, or improve our machine learning models and AI systems. We will not use your Customer Content for AI training without your prior consent, and you may withdraw consent at any time. See Section 4 for more details.

2.4 For Marketing and Communications

Send you information about our Services, updates, newsletters, and promotional materials. You can opt out of marketing communications at any time.

2.5 For Legal and Compliance Purposes

Comply with applicable laws and regulations; respond to legal process; enforce our Terms of Service; protect our rights, privacy, safety, or property; and detect and prevent fraud or security incidents.

3. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

3.1 Service Providers

We share information with third-party vendors who perform services on our behalf, such as cloud hosting, payment processing, analytics, and customer support. These providers are contractually obligated to use your information only for the purposes of providing services to us and to maintain appropriate security measures.

3.2 AI and Machine Learning Providers

To provide our Services, we use third-party AI and machine learning providers to process Customer Content. These providers process data solely to deliver the requested functionality and are contractually prohibited from using your data for their own purposes, including training their own models.

3.3 Integrations

If you connect third-party services to our platform (such as CRMs or payment processors), we share information as necessary to enable those integrations to function.

3.4 Business Transfers

If Callix is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a different privacy policy.

3.5 Legal Requirements

We may disclose your information if required by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

4. AI and Machine Learning

4.1 How We Use AI

Our Services use artificial intelligence and machine learning to analyze Customer Content and generate insights. This includes transcribing recordings, identifying patterns, extracting buyer profiles, and generating creative recommendations.

4.2 AI Training

We do not use your Customer Content to train our AI models unless you provide explicit consent. If you opt in:
• Your data will be used solely to improve the Callix platform
• You may withdraw consent at any time by contacting us
• Withdrawal of consent does not affect training that occurred prior to withdrawal

4.3 Third-Party AI Providers

We use third-party AI providers (such as large language model APIs) to process Customer Content. We have contractual agreements with these providers that prohibit them from using your data to train their own models or for any purpose other than providing services to Callix.

4.4 AI Limitations

AI-generated outputs may contain errors, inaccuracies, or biases. Our Services are not a substitute for human judgment or professional advice. You are responsible for reviewing and validating all outputs before relying on them.

5. Data Retention

We retain your information for as long as necessary to provide our Services and fulfill the purposes described in this Policy. Specifically:

Account Information: Retained while your account is active and for a reasonable period thereafter to comply with legal obligations and resolve disputes.

Customer Content: Retained for the duration of your subscription. Upon termination, Customer Content is deleted within 60 days unless you request earlier deletion or we are required by law to retain it.

Usage Data: Retained in identifiable form for up to 24 months, after which it may be retained in aggregated or de-identified form.

Marketing Data: Retained until you opt out or request deletion.

6. Your Rights and Choices

6.1 Access and Portability

You may request access to the personal information we hold about you and receive a copy in a portable format.

6.2 Correction

You may request that we correct inaccurate personal information.

6.3 Deletion

You may request that we delete your personal information, subject to certain exceptions (such as legal retention requirements).

6.4 Opt-Out of Marketing

6.5 Withdraw Consent

Where we rely on consent to process your information, you may withdraw consent at any time.

6.6 State-Specific Rights

California (CCPA/CPRA): California residents have the right to know what personal information we collect, request deletion, opt out of sales (we do not sell personal information), and not be discriminated against for exercising these rights.

Virginia (VCDPA), Colorado, Connecticut, Utah: Residents of these states have similar rights to access, correct, delete, and opt out of certain processing activities.

7. Customer Responsibilities

Our customers upload content and use our AI Notetaker feature, which may involve personal information about third parties (such as prospects and customers on sales calls). If you are a Callix customer:

• You are responsible for ensuring you have obtained all necessary consents from individuals whose information you upload to our Services or whose calls are recorded by our AI Notetaker, including consents required for recording conversations under applicable law.

• When using our AI Notetaker, you are responsible for ensuring all call participants are notified that the call will be recorded and that the notetaker bot is present. The notetaker will identify itself when joining calls, but you remain responsible for obtaining appropriate consent.

• You are responsible for providing appropriate privacy notices to individuals whose information you process using our Services.

• You are the "controller" or "business" (under applicable data protection laws) with respect to personal information you upload or capture using our Services, and Callix acts as a "processor" or "service provider" on your behalf.

Our Data Processing Agreement, available upon request at privacy@callix.io, governs our processing of personal information on your behalf.

8. Data Security

We implement appropriate technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include:

• Encryption of data in transit and at rest
• Access controls and authentication requirements
• Regular security assessments and monitoring
• Employee training on data protection

However, no method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

9. International Data Transfers

Callix is based in the United States, and our Services are hosted in the United States. If you access our Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.

For transfers of personal data from the European Economic Area, United Kingdom, or Switzerland, we rely on appropriate safeguards such as Standard Contractual Clauses approved by the European Commission.
